DMCA Takedown Policy

Introduction

At Fixturenest, we value and respect intellectual property rights. In compliance with the Digital Millennium Copyright Act (DMCA), we have established the following policy to respond promptly to claims of copyright infringement. This policy is aligned with the requirements outlined in 17 USC section 512(c)(3).


DMCA Notice of Alleged Infringement

If you are the copyright owner or an authorized agent acting on their behalf, and you believe that content available on our website infringes your copyright, please submit a DMCA notice to our Designated Copyright Agent.

Your notice must include the following information:

  1. Description of the copyrighted work that you claim has been infringed

  2. Description of the infringing material and its location on the website (include a URL if possible)

  3. Your contact information, including name, company (if applicable), mailing address, telephone number, and email address

  4. A good faith statement that you believe the disputed use is not authorized by the copyright owner, their agent, or the law

  5. A statement of accuracy, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

  6. Your full legal name and your electronic or physical signature

Upon receiving a proper notice, we will take appropriate action, which may include removal of the content in question.


DMCA Counter Notice

If you believe that the content removed or disabled by mistake is not infringing, or you have authorization to use the material, you may submit a counter notice.

Your counter notice must include:

  1. Your electronic or physical signature

  2. Identification of the removed content and its location before removal

  3. Your contact information including name, address, phone number, and email

  4. A statement of consent to the jurisdiction of the federal court in your state or country and agreement to accept service of process from the original complaining party

  5. A good faith statement that you believe the content was removed due to mistake or misidentification

If we receive a valid counter notice, we may notify the original party and restore the content within ten business days, unless the original party files legal action.


Repeat Infringers

Fixturenest does not tolerate repeated copyright infringement. We reserve the right to terminate access or restrict services to users we determine to be repeat infringers. This determination may be based on receiving two or more valid DMCA notices against the same user, among other factors.


Legal Terms

Fixturenest reserves all legal rights to pursue remedies against individuals or entities that violate intellectual property rights. We do not indemnify or represent any user accused of infringement.
